2. Your Account & Responsibilities

To make purchases, you may need to create an account. You agree to:

• Provide accurate, current, and complete information.
• Maintain the security of your password and account.
• Promptly update your information if it changes.
• Accept responsibility for all activities that occur under your account.
• Not use the site for any illegal or unauthorized purpose.

We reserve the right to refuse service, terminate accounts, or cancel orders at our sole discretion, including for conduct we believe violates these Terms or harms our community.

Important Product Notes:

• We strive for accurate product images and descriptions, but slight variations in color or detail may occur.
• Product availability is subject to change. If an item becomes unavailable after you order, we will notify you promptly.
• Some items are marked as “Final Sale” (see Section 7).

4. Orders & Payment Terms

Placing an Order:

Adding an item to your cart is an invitation to offer. A contract is only formed when we send you an order confirmation email.

Pricing:

Prices are listed in US Dollars (USD). We reserve the right to correct pricing errors, even after an order is placed.

Payment Methods:

We accept: Visa, MasterCard, JCB, and PayPal. Your payment is processed securely at checkout.

Order Processing & Shipping:

• Processing: Orders are processed within 1-2 business days after payment confirmation.
• Shipping Methods:
  • Standard Shipping ($12.95): Via DHL or FedEx. Delivery in 10-15 business days after shipment.
  • Free Shipping (Orders over $50): Via EMS. Delivery in 15-25 business days after shipment.
• Shipping Regions: We ship globally, but delivery to some remote areas (particularly in Asia) may be unavailable or delayed. Final availability is confirmed at checkout.
• Delivery Times: Are estimates. Delays can occur due to customs, weather, or carrier issues.
• Import Duties & Taxes: You are responsible for any customs duties, taxes, or fees levied by your country. These are not included in our prices or shipping costs.

5. Returns, Exchanges & Refunds (Our Geek-Friendly Guarantee)

We want you to love your gear. Our full policy is on the homepage, but here are the key legal points:

• Window: You have 15 days from the date of delivery to request a return or exchange.
• Condition: Items must be unused, unopened, in original packaging with all tags and accessories.
• Process: You must contact us at [email protected] to obtain a Return Merchandise Authorization (RMA) number before sending anything back.
• Non-Returnable (Final Sale) Items:
  • Personalized/Customized items (e.g., engraved CosCups).
  • Opened software, games, or downloadable content.
  • Intimate apparel & fancy dress with removed protective packaging.
  • Items explicitly marked “Final Sale” or “Clearance.”
  Seasonal items (e.g., Christmas) are returnable if standard conditions are met.
• Refunds: Issued to the original payment method within 5-10 business days after we receive and approve the return. Original shipping costs are non-refundable. Return shipping is the customer’s responsibility unless we made an error.
• Damaged/Defective Items: Contact us immediately with photos. We will cover return shipping and expedite a replacement or refund.

6. Intellectual Property

All content on this site (logos, text, graphics, button icons, images, software) is the property of Just Geek Store or our licensors and is protected by international copyright and trademark laws.

The products we sell contain intellectual property (characters, logos, designs) owned by their respective rights holders (e.g., game studios, anime publishers). We are licensed sellers. When you purchase a product, you are buying the physical item, not the IP rights. You may not reproduce, distribute, or create derivative works from the products or site content for commercial purposes.

7. Limitation of Liability

To the fullest extent permitted by law:

• Just Geek Store shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your use of the site or products.
• Our total liability for any claim arising from your order shall not exceed the purchase price of the product(s) in question.
• We are not responsible for delays or failures in performance due to causes beyond our reasonable control (force majeure), including acts of God, war, embargoes, strikes, or internet/utility failures.
• This limitation does not affect any liability which cannot be excluded or limited under applicable law, such as for death, personal injury, or fraud.

8. General Provisions

Governing Law:

These Terms are governed by the laws of the State of Nevada, United States, without regard to its conflict of law principles.

Disputes:

Any dispute relating in any way to your visit to the site or purchase from us shall be submitted to confidential arbitration in Las Vegas, Nevada, except that we may seek injunctive relief in any court of competent jurisdiction.

Changes to Terms:

We may update these Terms periodically. The “Effective Date” at the top will indicate changes. Your continued use of the site after changes constitutes acceptance.

Severability:

If any provision of these Terms is found to be unlawful or unenforceable, that provision shall be severed, and the remaining provisions shall remain in full force.
